Terms and Conditions

Cost is an important factor in choosing where to book your stay and hunt package. While cost is a big factor, one should take all aspects into consideration such as what the cost includes or excludes, past client references and experiences shared,

the number of properties hunted, the size of the properties, the trophy quality, the experience of the hunting guides and ranch owners, the standard of accommodations as well as level of service and amenities that are offered.

Client refers to any person(s), purchasing and/or participating, in any capacity, in a hunt package with Rack-N-Horns. The Client must carefully read the following Terms and Conditions. Payment of non-refundable deposit, or any part thereof, hereby constitutes this agreement by the Client to the Terms and Conditions set forth below.

The information provided on the site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use will be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the site from other locations do so on their own initiative and are solely responsible for compliance with local laws if and to the extent local laws are applicable. 

The site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the site.

Rights Reserved
Rack-N-Horns reserves the right, if and when so deemed advisable, to cancel a hunting trip and or hunt package prior to the departure from the client’s point of origin or Rack-N-Horns Accommodations. In the case of cancellation prior to the client’s departure, the Client is entitled to receive from Rack-N-Horns a refund of all amounts received by the company out of the monies paid by the Client and such refund constitutes full and final settlement of all claims that the Client may have against Rack-N-Horns for such cancellation of the package. Rack-N-Horns reserves the right, at any time after commencement, to terminate the hunt package, when events or circumstances deem this course of action to be necessary for whatever reason, which may include but is not limited to the Clients’; misconduct and/or failure to comply with the Terms and Conditions set forth here, or any action which causes a danger to himself (the Client) or others. Additionally, Rack-N-Horns cannot be held responsible for violations of state or game laws by its’ Clients. Rack-N-Horns reserves the right, at any time, to deny the Client permission to shoot an animal for any reason.

Liability
Rack-N-Horns shall not be liable for any misrepresentations of its available services and/or costs made by the Agent or if for whatever reason it is unable to perform its obligations or carry out any related activities, if such failure is caused by events beyond its reasonable control preventing it from performing such obligations or carrying out such activities including, but without limiting the generality of the foregoing; acts of God, ranch disputes, labor disputes, riots, fire, acts of restraint by government authorities, loss, accident, illness, injury or death. Rack-N-Horns cannot be held liable or responsible for, but not limited to accident, injury, illness, death, loss of property or damage to property during the hunt or other activities during the Clients visit to the Ranch or any expense arising from such events.

Reservation & Payments
The Hunt Package reservation date can only be confirmed once a $500 non-refundable deposit per guest has been received by Rack-N-Horns. Rack-N-Horns retains the sole right to accept or refuse proposed reservation dates. The non-refundable deposit, required to confirm the reservation date, will be applied to the total cost of the hunt package. Payment of the balance is due prior to departure from the Rack-N-Horns. Prior to departure from Rack-N-Horns accommodations, Client shall be required to pay the full amount due, in an acceptable form of payment, for the entire Hunt Package including trophy fees, lodging, cape and quarter fees, package amenities, and any gratuities which could have been added. Rack-N-Horns regards only the following as acceptable forms of payment (in US $): bank transfers that have been received prior to Clients’ departure from the Rack-N-Horns accommodations, traveler’s checks, VISA, MasterCard, Discover or cash. All prices are in United States Dollars and are subject to change without notice.

Cancellation & Refunds
All Deposits are non-refundable. All cancellations must be submitted to Rack-N-Horns in writing. A minimum of 30 days written notice must be given for cancellations and rescheduling. Any cancellations prior to 30 days before trip, you must reschedule within 6 months. Cancellations less than 30 days before scheduled trip must be rescheduled within 3 months, and cancellations within 48 hours of your arrival time, deposits are forfeited. Should occurrences, unrelated to Rack-N-Horns, affect the scheduling of the hunt, all attempts will be made to adapt to the circumstances of the Client. Any increases in cost will be applied to the new hunt date.

Wounded Game
Wounded game (The Hunt Guide may determine by sight of Blood or Bone that you have wounded an animal) which is not recovered is considered as hunted and is not subject to refund. The possibility to hunt another specimen is dependent upon approval by the Guide and Ranch Owner. If the Client wounds or kills the incorrect game animal, one other than which was contracted in the original hunt package, Client is responsible for the Trophy Fee and all applicable damages due to the ranch owner, before departing the Rack-N-Horns ranch.

No Kill Policy
In the event that the Client does not have an opportunity to harvest (a wounded animal is considered harvested) the Wild Game animal that he/she has contracted for in the normal Hunt package offered by Rack-N-Horns, the Rack-N-Horns will refund the Trophy Fee portion of the Clients Hunt Package. The portions of the Hunt Package which will not be refunded will include those applicable to Accommodations, Taxes, Guide Fees, Ranch-Use Fees, Food and Beverages, use of Rack-N-Horns amenities, transportation costs and any other costs not associated with the Trophy Fee.

Trophy Scores
In the event that the client harvests or wounds an animal that must be scored to determine price of the trophy.. Rack-N-Horns utilizes TGR (Trophy Game Records of the World) and SCI (Safari Club International) scoring methods only. If the animals has points, antlers or horns which have been broken or cracked due to natural causes while the animal was alive due to rut or fighting, then the measurements of those missing points, within reason, will be calculated towards the final cost of the trophy fee only. (Example: A hunter chooses to shoot a 12 Point Whitetail Deer that has broken a brow-tine; it was that hunters choice to shoot that deer, and he/she will be responsible for the trophy fee associated with that animal as if the animal still has all 12 points intact.)?

Air Travel
All air travel arrangements are the responsibility of the Client, Rack-N-Horns will not be liable for losses or costs incurred due to untimely processing of airline reservations, airline problems, weather or unforeseeable  events of travel. Obtaining any necessary visa is the sole responsibility of the Client.

Taxidermy and Meat Processing
Once Rack-N-Horns has delivered the Clients’ trophies to the appropriate third party, taxidermist, meat processor or shipping agent, it no longer assumes any responsibility whatsoever for its damage or loss.

Governing Laws
Disputes between Client or Agents and Rack-N-Horns shall be governed, interpreted, and enforced pursuant to the laws of the State of Texas, USA. The Terms of Use and your use of the Site and experiences offered are governed by and construed in conformity with the law of the State of Texas applicable to agreements made and to the totality performed within the State of Texas, without regard to its conflict law of principles.

Limitations of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect nonsequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or our ranch. Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will always be limited to the amount paid, if any, by you to us during the six-month period prior to any cause of action arising. 

User Data

We will maintain certain data that you send to our Site for the purpose of managing the purpose of the Site, as well as data relating to your use of the Site and booking inquiries. Although we perform regular routine backups of data, you are solely responsible for all the data that you send or that relates to any activity you have undertaken using the Site. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of data.

Privacy Agreement

Rack-N-Horns reserves the right to inspect and authorize all photographs, videos, and printed electronic matter that may be used now or in the future, whether that use is known or unknown to Rack-N-Horns, all rights to royalties or other compensation arising from or related to content created on Rack-N-Horns property or premises is proprietary intellectual property of Rack-N-Horns. All photography and videography taken on Rack-N-Horns property must be previously approved by Rack-N-Horns management.
